A kerb drop is a legal requirement if you want to drive over the pavement onto your residential or commercial property.

Any entry onto a public highway from a domestic or commercial driveway area should have a vehicle crossover.

Kerb dropping allows vehicles to cross the pavement from the road to a driveway and it is a legal requirement if you intend to drive across the pavement onto your property.

Kerb drops, also known as vehicle access crossovers, are an adaptation to the footpath. It involves lowering the kerb and laying new foundations to the paving to make it possible for a car to be driven onto the front area of a property.

The work includes lowering the kerbstones and bolstering the pavement to create a ramp, and must only be performed by an authorised company with Street Works Accreditation, and who have the required Public Liability insurance to fulfill the local authorities requirements.

Vehicle access cross overs comprise normally of 3 or 4 dropped kerbs with a tapered or transition kerb on either side. The standard maximum total width at road level for a VAC is 3.6 metres (i.e. normally 4 kerbs).

The huge growth in demand for off-street parking has seen a growing number of people drop kerbs to create car standing at the front of their properties.

Study by home insurer Direct Line shows that off-street parking is regarded by estate agents as a beneficial feature which adds market value to a property. This, combined with increasing parking limitations in lots of residential areas, has resulted in planning applications  increase massively over recent years.

But while putting in car standing space to the front of your home may well add market value to your property, there are many things to take into consideration, not least environmental consequences, and flooding is a major problem.

When you switch out a front garden with hard standing, rain can no longer soak into the ground. As more and more households take this action, the cumulative effect severely increases the risk of flooding, so it’s important to include drainage in your plans.

Planning permission is usually needed if you wish to drop the kerb outside your building to enable a car to cross the pavement. This is due to the fact that the pavement may need to be strengthened to take the weight of motor vehicles and help prevent them from damaging the surface or any water pipes or cables underneath. It is in addition to ensure the new access will never be a safety hazard to other highway users.

You can learn if you require planning permission by getting in touch with your local council (you can identify the relevant council at the government website). How much it costs to apply will be dependent on your specific location.

If permission is given, you then you need to locate a local professional to do the work for you.

It’s definitely not a DIY job as the council will have requirements that service providers must meet. Some will only permit you to use their approved contractors, while others make it possible for you to use your own, as long as they are accredited to the requirements of the New Roads and Street Works Act 1991, and carry public liability insurance. In this case, there may be an added fee for highway assessments by the council.

But first it’s worth verifying if permission is likely to be granted. Below is a list of considerations. If any one of these criteria is not really met, planning permission is most likely to be refused:

  • Your front garden must be big enough for you to park your vehicle completely on your property.
  • The kerb must be at minimum 4.8 m from the front of your house; or 6m if the parking area is in front of an entrance or garage.
  • The parking area should be at least 2.4 m wide.
  • The suggested access to your property should be more than 10m away from a road junction; 15m away from busy junctions or on major roads.
  • It must be at least 1.5 m away from street lamps and various other street furniture.
  • It must meet visibility standards; this depends on the type of road.
  • Suitable drainage must be provided to remove the excess surface water.
The extraction of tree roots should be avoided.
  • The slope from your home to the road must not be too steep.
  • Lastly, you as the homeowner must agree to the kerb being dropped; for instance, a tenant can not apply on their landlord’s behalf.

Q and A’s

Prices can vary depending upon where you are located, what width you have, how many kerbs need to be dropped, and whether you need to extend an existing drop kerb. Some councils or contractors will provide an extended, dropped kerb at no charge. Others may charge up to £1800. The job itself usually takes around 1 to 2 days.

Highways Act 1980 Section 184, makes it an offense for a vehicle to be driven across a footway. These include the permission for a vehicle to cross the public footway and the physical lowering the kerb.

A driveway with an average length will require you to lower five of the kerb sections. Your local Council will be your highway authority. This assumes that the Council has the road and footpath. The Council may refuse to grant permission as either a roads authority or a planning authority, or both.

A dropped kerb is a sloped area that the vehicle crosses between the road and the property’s front. It is often a driveway with dropped kerbs.

Parking a vehicle fully or partially across a dropped kerb is classed as an obstruction and either the police or local council can enforce the contravention. Even though it sounds absurd, you may be issued a PCN to park on top of your own dropped curb.

Parking across a dropping kerb can be a parking contravention that could result in a Penalty-Charge Notice being issued. This means that you can’t park in front of a dropped-kerb without permission.

A spot for a vehicle will bring additional value to your property. The amount you pay will depend on whereabouts. Also, you must apply for a drop kerb to your property.

Between the junction’s entrance and the proposed location for vehicular access, there must be at most 10m. No part of a vehicle parked within your property may overhang the pavement or road.

Planning permission is usually required if you wish to drop the kerb outside your property to allow a car to cross the pavement. This is because vehicles may cause damage to the pavement or pipes or cables below, and the pavement may need strengthening to support the load.

Dropped kerb is required if you plan to drive your vehicle across the footway from your driveway onto a highway. You cannot drive on the footway if you don’t have a dropped curb. If you do this, you may be charged with breaking the law.
