If you do not, you must never drive over the footway. If you do so, you are breaking the law and enforcement action may be taken to stop such practice.

Kerb drops, also referred to as vehicle access crossovers, are an adaptation to the footpath. It entails lowering the kerb and preparing new foundations to the paving to enable a car to be driven onto the front area of a property.

The work includes lowering the kerbstones and strengthening the pavement to create a ramp, and must solely be performed by an authorised company with Street Works Accreditation, and who have the necessary Public Liability insurance to comply with the local authorities regulations.

Vehicle access cross overs consist normally of 3 or 4 dropped kerbs with a tapered or transition kerb on either side. The standard maximum total width at road level for a VAC is 3.6 metres (i.e. normally 4 kerbs).

The massive growth in demand for off-street parking has seen a growing number of people drop kerbs to establish car standing at the front of their properties.

Research by home insurer Direct Line shows that off-street parking is regarded by estate agents as a desirable feature which adds market value to a residential or commercial property. This, combined with increasing parking restrictions in lots of residential locations, has brought about planning applications  increase massively over recent years.

However while putting in car standing space to the front of your home can add market value to your property, there are many things to take into consideration, not least environmental consequences, and flooding is a major worry.

When you switch out a front lawn with hard standing, rain can no longer soak into the ground. As more and more households take this action, the cumulative effect severely increases the danger of flooding, so it’s important to include drainage in your plans.

Planning permission is normally needed if you wish to drop the kerb outside your property to permit a car to cross the pavement. This is because the pavement might need to be reinforced to take the weight of motor vehicles and prevent them from damaging the surface or any water pipes or cables beneath. It is also to ensure the new access will never be a safety hazard to other highway users.

You can find out if you require planning permission by getting in touch with your local council (you can find the relevant council at the government website). How much it costs to apply will be dependent on your specific location.

If permission is given, you then you need to locate a local specialist to do the work for you.

It’s definitely not a DIY job as the council will have requirements that contractors must meet. Some will only allow you to use their endorsed contractors, while others allow you to use your own, as long as they are accredited to the requirements of the New Roads and Street Works Act 1991, and carry public liability insurance. For this case, there might be an additional charge for highway assessments by the council.

However first it’s worth verifying if permission is likely to be given. Below is a checklist of points to consider. If any one of these criteria is not really met, planning permission is probably to be turned down:

  • Your front garden must be large enough for you to park your vehicle entirely on your property.
  • The kerb must be at least 4.8 m from the front of your house; or 6m if the parking spot is in front of a door or garage.
  • The parking area should be at least 2.4 m wide.
  • The suggested access to your property should be more than 10m away from a road junction; 15m away from busy junctions or on major roads.
  • It has to be at least 1.5 m away from street lights and various other street furniture.
  • It must meet visibility guidelines; this is dependent on the type of road.
  • Appropriate drainage must be provided to take the excess surface water.
The removal of tree roots should be avoided.
  • The incline from your property to the road must not be too steep.
  • Finally, you as the property owner must agree to the kerb being dropped; for example, a renter can not apply on their landlord’s behalf.

Q and A’s

Prices will vary depending on your location, width of pavement, the number of kerbs to drop and if you want to extend an existing dropped kerb. Some contractors and councils offer an extended dropped kerb for free, while some charge up to $1800 or more. The actual job usually takes between 1 and 2 days.

Highways Act 1980 Section 184, makes it a crime to drive a vehicle along a footway. They can be used to permit vehicles to cross the public footway.

Five kerb sections will be required to make a driveway average. You will need to obtain permission from your local Council as highway authority, assuming that the Council owns the road and footpath. The Council might decide not to grant permission, either as a roads authority or planning authority, or both.

A dropped curb is the area where the vehicle crosses over from the road to the property’s rear. Often it is a driveway with a dropped kerb.

Obstructing a drop kerb with a vehicle is an offense. It can be enforced by the police or local council. It doesn’t matter how absurd, you can be issued an NPCN for parking your vehicle across your dropped kerb.

Parking across a dropped street is a parking violation that can result in a Penalty Cost Notice. You can be fined for parking on a dropped kerb if you don’t have permission.

A spot for a vehicle will bring additional value to your property. The amount you pay will depend on whereabouts. A drop kerb outside of your property will require you to complete an application.

It must be at least 10 m between the entrance to the junction or sharp corner and where the proposed vehicular accessibility is located. The pavement or road must not be overhang by any vehicle that is parked within your property.

You will need to obtain permission to drop the kerb from your property so that a car can cross the pavement. Because vehicles can cause damage to the pavement, or to any pipes or cables under it, the pavement may need reinforcement.

Dropped kerbs are required for vehicles that will be driven over the footway to your driveway from a highway. You cannot drive on the footway if you don’t have a dropped curb. Doing so is a violation of the law, and enforcement actions could be taken against you.
