The law pertaining to the access states: If you plan to drive a vehicle over the footway in to your driveway off a highway, then you will need make these changes to your access.

If you do not, you must never drive over the footway. If you do so, you are breaking the law and enforcement action might be taken to stop such practice.

Kerb drops, also known as vehicle access crossovers, are an adaptation to the footpath. It entails lowering the kerb and preparing new foundations to the paving to enable a car to be driven onto the front area of a property.

The work includes lowering the kerbstones and bolstering the pavement to create a ramp, and must solely be performed by an authorised company with Street Works Accreditation, and who have the required Public Liability insurance to fulfill the local authorities regulations.

Vehicle access cross overs comprise normally of 3 or 4 dropped kerbs with a tapered or transition kerb on either side. The conventional maximum total width at road level for a VAC is 3.6 metres (i.e. normally 4 kerbs).

The huge growth in interest for off-street parking has seen a growing number of people drop kerbs to establish car standing at the front of their homes.

Study by home insurer Direct Line shows that off-street parking is seen by estate agents as a beneficial feature which adds value to a property. This, coupled with increasing parking limitations in many residential areas, has resulted in planning applications  increase massively over recent years.

However while adding car standing space to the front of your home might add value to your property, there are many things to think about, not least environmental consequences, and flooding is a major issue.

When you replace a front lawn with hard standing, rainwater can no longer soak into the ground. As increasingly more households take this step, the cumulative effect severely increases the threat of flooding, so it’s essential to include drainage in your plans.

Planning permission is normally required if you wish to drop the kerb outside your building to permit a car to cross the pavement. This is due to the fact that the pavement might need to be strengthened to take the weight of vehicles and help prevent them from damaging the surface or any water pipes or cables underneath. It is also to ensure the new access will never be a safety risk to other highway users.

You can find out if you need planning permission by contacting your local council (you can identify the relevant council at the government website). How much it costs to apply will depend on your location.

If permission is approved, you then you need to locate a local contractor to perform the work for you.

It’s definitely not a DIY job as the council will have requirements that service providers must meet. Several will only permit you to use their approved contractors, while others allow you to use your own, just as long as they are certified to the requirements of the New Roads and Street Works Act 1991, and hold public liability insurance. For this case, there might be an additional charge for highway assessments by the council.

However first it’s worth establishing if consent is likely to be granted. Below is a checklist of points to consider. If any one of these criteria is not met, planning permission is likely to be rejected:

  • Your front garden needs to be big enough for you to park your vehicle completely on your property.
  • The kerb needs to be at least 4.8 m from the front of your house; or 6m if the parking area is in front of a door or garage.
  • The parking area should be at least 2.4 m wide.
  • The suggested access to your property should be more than 10m away from a road junction; 15m away from busy junctions or on primary roads.
  • It has to be at least 1.5 m away from street lights and other street furniture.
  • It must meet visibility standards; this depends on the type of road.
  • Suitable drainage needs to be provided to remove the excess surface water.
The extraction of tree roots should be avoided.
  • The incline from your property to the road must not be too steep.
  • Lastly, you as the homeowner must consent to the kerb being dropped; for example, a tenant can not apply on their landlord’s behalf.

Q and A’s

Prices will vary depending on the location and width of your pavement. While some councils and contractors offer extended dropped kerbs for free, others charge as much as £1800. The entire process usually takes 1 to 2 working days.

Highways Act 1980, Section 184 makes it an offense to drive a vehicle over a footway or verge where there is no vehicle crossing. These are the physical lowering (or dropping) of the kerb and permission to allow vehicles to cross on the public footway.

You will need to reduce five kerb sections for an average driveway. You will need to obtain permission from your local Council as highway authority, assuming that the Council owns the road and footpath. The Council could refuse permission, as a roads authority, planning authorities, or both.

A dropped kerb is the sloped area where the vehicle crosses from the road to the front of the property. This is most often a driveway with drop kerb.

Parking a vehicle fully or partially across a dropped kerb is classed as an obstruction and either the police or local council can enforce the contravention. It doesn’t matter how absurd, you can be issued an NPCN for parking your vehicle across your dropped kerb.

Parking across a dropped curb is a parking offense that can lead to a Penalty Fee Notice. This means that if you park on top of a dropped brick, you are guilty of an offence.

A car spot will add extra value to your home, but it will vary depending on where you live. It iss also worth bearing in mind that you will have to go through an application process to a get a dropped kerb outside your property, too.

Between the junction’s entrance and the proposed location for vehicular access, there must be at most 10m. Your vehicle cannot be parked in an area that exceeds the roadway or pavement.

You will need to obtain permission to drop the kerb from your property so that a car can cross the pavement. This is because pavement may need to have additional strength to handle the vehicle’s weight, as well as protect any pipes or cables underneath.

A dropped kerb will be required if your plan is to drive your vehicle over the footway in your driveway, off a highway. You cannot drive on the footway if you don’t have a dropped curb. If you do so, you are breaking the law and enforcement action could be taken to prevent such practice.
