A kerb drop is a legal requirement if you want to drive across the pavement onto your property.

Any access onto a public highway from a domestic or commercial driveway area should have a vehicle crossover.

Kerb dropping allows vehicles to cross the pavement from the road to a driveway and it is a legal requirement if you wish to drive across the pavement onto your property.

Putting in a vehicle access crossover can make a significant improvement to easy access your property as well as helping to ensure people do not park across your driveway.

The law pertaining to the access states: If you plan to drive a vehicle over the footway into your driveway off a highway, then you will need to make these changes to your access.

If you do not, you must never drive over the footway. If you do so, you are breaking the law and enforcement action might be taken to stop such practice.

The pavement may need to be reinforced in front of the property, and in many cases, it may be necessary for lampposts, manhole covers and various other street furniture to be relocated.

Kerb drops, also called vehicle access crossovers, are an alteration to the footpath. It entails lowering the kerb and preparing new foundations to the paving to make it possible for a car to be driven onto the front area of a property.

The work involves lowering the kerbstones and strengthening the pavement to create a ramp, and must only be performed by an authorised company with Street Works Accreditation, and who have the necessary Public Liability insurance to fulfill the local authorities requirements.

Vehicle access cross overs consist normally of 3 or 4 dropped kerbs with a tapered or transition kerb on either side. The conventional maximum total width at road level for a VAC is 3.6 metres (i.e. normally 4 kerbs).

Our team have several years experience in installing drop kerbs and making an application for the appropriate planning permission. We are able to work in partnership with your local county council  whilst complying with all necessary regulations.

The huge growth in interest for off-street parking has seen more and more people drop kerbs to create car standing at the front of their homes.

Study by home insurer Direct Line shows that off-street parking is regarded by estate agents as a beneficial feature which adds value to a property. This, combined with escalating parking restrictions in many residential locations, has resulted in planning applications  increase massively over recent years.

But while putting in car standing space to the front of your home may well add value to your property, there are numerous things to take into consideration, not least environmental issues, and flooding is a major issue.

When you replace a front garden with hard standing, rainwater can no longer absorb into the ground. As more and more households take this action, the collective effect seriously increases the risk of flooding, so it’s essential to incorporate drainage in your plans.

Planning permission is usually required if you wish to drop the kerb outside your property to allow a car to cross the pavement. This is due to the fact that the pavement might need to be reinforced to take the weight of motor vehicles and prevent them from damaging the surface or any water pipes or cables beneath. It is also to ensure the new access will never be a safety hazard to other highway users.

You can find out if you need planning permission by contacting your local council (you can identify the relevant council at the government website). How much it costs to apply will be dependent on your specific location.

If permission is given, you then you need to locate a local professional to do the work for you.

It’s definitely not a DIY job as the council will have requirements that service providers must meet. Some will only allow you to use their endorsed contractors, while others make it possible for you to use your own, as long as they are accredited to the requirements of the New Roads and Street Works Act 1991, and carry public liability insurance. For this case, there might be an added fee for highway assessments by the council.

But first it’s worth verifying if consent is likely to be given. Below is a checklist of considerations. If any one of these criteria is not really met, planning permission is probably to be denied:

  • Your front garden needs to be big enough for you to park your vehicle completely on your property.
  • The kerb needs to be at least 4.8 m from the front of your house; or 6m if the parking area is in front of an entrance or garage.
  • The parking area should be at least 2.4 m wide.
  • The suggested access to your property should be more than 10m away from a road junction; 15m away from busy junctions or on major roads.
  • It must be at least 1.5 m away from street lamps and various other street furniture.
  • It must meet visibility standards; this depends upon the type of road.
  • Suitable drainage needs to be provided to remove the excess surface water.
The removal of tree roots should be avoided.
  • The incline from your property to the road must not be too steep.
  • Finally, you as the property owner must consent to the kerb being dropped; as an example, a renter can not apply on their landlord’s behalf.

Q and A’s

Prices can vary depending upon where you are located, what width you have, how many kerbs need to be dropped, and whether you need to extend an existing drop kerb. Some contractors and councils offer an extended dropped kerb for free, while some charge up to $1800 or more. The entire job takes about 1 to 2 hours.

Highways Act 1980 Section 184 states that it is an offense to drive a vehicle on a footway or verge if there isn’t a proper vehicle crossing. These are the physical lowering (or dropping) of the kerb and permission to allow vehicles to cross on the public footway.

A driveway with an average length will require you to lower five of the kerb sections. Your local Council will be your highway authority. This assumes that the Council has the road and footpath. The Council may deny permission for any reason, be it as a roads or planning authority, but also both.

A dropped kerb is a sloped area that the vehicle crosses between the road and the property’s front. A driveway often has a dropped curb.

If you park your vehicle partially or completely across a dropped kerb, it is considered obstruction. This can be enforced either by the police and the council. Even though it sounds absurd, you may be issued a PCN to park on top of your own dropped curb.

Parking across a dropping kerb can be a parking contravention that could result in a Penalty-Charge Notice being issued. If you park across a dropped curb, you will be charged with an offense unless you have permission.

A spot for a vehicle will bring additional value to your property. The amount you pay will depend on whereabouts. Keep in mind, however, that dropping a kerb on your property outside will require you to submit an application.

It must be at least 10 m between the entrance to the junction or sharp corner and where the proposed vehicular accessibility is located. Your vehicle cannot be parked in an area that exceeds the roadway or pavement.

If you plan to remove the kerb on your property and allow cars to cross the pavement, permission is required. The pavement might need to be reinforced to withstand the vehicles’ weight and to prevent damage to the pipes or cables beneath.

Dropped kerb is required if you plan to drive your vehicle across the footway from your driveway onto a highway. A dropped kerb is required for any vehicle that crosses the footway. Doing so is a violation of the law, and enforcement actions could be taken against you.
