A kerb drop is a legal necessity if you wish to drive over the pavement onto your property.

Any entry onto a public highway from a domestic or commercial driveway area should have a vehicle crossover.

Kerb dropping permits vehicles to cross the pavement from the road to a driveway and it is a legal necessity if you wish to drive across the pavement onto your property.

Putting in a vehicle access crossover can make a huge improvement to easy access your property along with helping to ensure people do not park across your driveway.

The law regarding the access states: If you plan to drive a vehicle over the footway in to your driveway off a highway, then you will need make these changes to your access.

If you do not, you must not drive over the footway. If you do this, you are breaking the law and enforcement action may be taken to stop such practice.

The pavement may need to be reinforced in front of the property, and sometimes, it may be necessary for lampposts, manhole covers and various other street furniture to be moved.

Kerb drops, also called vehicle access crossovers, are an adaptation to the footpath. It involves lowering the kerb and laying new foundations to the paving to enable a car to be driven onto the front area of a property.

The work involves lowering the kerbstones and strengthening the pavement to create a ramp, and must solely be performed by an authorised provider with Street Works Accreditation, and who have the necessary Public Liability insurance to fulfill the local authorities regulations.

Vehicle access cross overs comprise normally of 3 or 4 dropped kerbs with a tapered or transition kerb on either side. The conventional maximum total width at road level for a VAC is 3.6 metres (i.e. normally 4 kerbs).

The massive growth in interest for off-street parking has seen a growing number of people drop kerbs to establish car standing at the front of their properties.

Study by home insurer Direct Line shows that off-street parking is seen by estate agents as a desirable feature which adds value to a residential or commercial property. This, coupled with escalating parking limitations in many residential locations, has resulted in planning applications  increase greatly over recent years.

However while adding car standing space to the front of your home can add value to your property, there are many things to take into consideration, not least environmental consequences, and flooding is a big problem.

When you switch out a front lawn with hard standing, rainwater can no longer absorb into the ground. As more and more households take this action, the cumulative effect seriously increases the threat of flooding, so it’s important to include drainage in your plans.

Planning permission is normally required if you wish to drop the kerb outside your property to allow a car to cross the pavement. This is due to the fact that the pavement may need to be reinforced to take the weight of motor vehicles and help prevent them from damaging the surface or any water pipes or cables underneath. It is also to ensure the new access will not be a safety risk to other highway users.

You can learn if you need planning permission by contacting your local council (you can find the relevant council at the government website). How much it costs to apply will depend on your location.

If permission is given, you then you need to find a local contractor to perform the work for you.

It’s certainly not a DIY job as the council will have criteria that contractors must meet. Some will only allow you to use their approved contractors, while others make it possible for you to use your own, so long as they are certified to the requirements of the New Roads and Street Works Act 1991, and hold public liability insurance. For this case, there may be an additional charge for highway inspections by the council.

However first it’s worth verifying if permission is likely to be given. Below is a checklist of considerations. If any among these criteria is not met, planning permission is very likely to be refused:

  • Your front garden must be big enough for you to park your vehicle fully on your property.
  • The kerb must be at least 4.8 m from the front of your house; or 6m if the parking area is in front of an entrance or garage.
  • The parking area should be at least 2.4 m wide.
  • The suggested access to your property should be more than 10m away from a road junction; 15m away from busy junctions or on major roads.
  • It must be at least 1.5 m away from street lamps and various other street furniture.
  • It must meet visibility standards; this depends upon the type of road.
  • Suitable drainage must be provided to take the excess surface water.
The removal of tree roots should be avoided.
  • The slope from your home to the road must not be too steep.
  • Finally, you as the homeowner must agree to the kerb being dropped; for instance, a tenant can not apply on their landlord’s behalf.

Q and A’s

Prices can vary depending upon where you are located, what width you have, how many kerbs need to be dropped, and whether you need to extend an existing drop kerb. Some councils and contractors provide an extended dropped curb for no cost, while others charge up to £1800. The actual job usually takes between 1 and 2 days.

Highways Act 1980 Section 184 states that it is an offense to drive a vehicle on a footway or verge if there isn’t a proper vehicle crossing. They can be used to permit vehicles to cross the public footway.

For an average driveway, you will probably want to lower five kerb sections. You will need to obtain permission from your local Council as highway authority, assuming that the Council owns the road and footpath. The Council may refuse to grant permission as either a roads authority or a planning authority, or both.

A dropped kerb is a sloped area that the vehicle crosses between the road and the property’s front. It is often a driveway with dropped kerbs.

Parking a vehicle fully or partially across a dropped kerb is classed as an obstruction and either the police or local council can enforce the contravention. As absurd as it might sound, you can receive a PCN to park across your own dropped-kerb.

Parking across a dropped street is a parking violation that can result in a Penalty Cost Notice. This means if you park in across a dropped kerb you are committing an offence unless you have permission.

A car spot will add extra value to your home, but it will vary depending on where you live. Keep in mind, however, that dropping a kerb on your property outside will require you to submit an application.

There must be at least 10 metres between the entrance to a junction or sharp corner and the location of the proposed vehicular access. You must ensure that no part of your vehicle is parked on the road or pavement.

If you want to remove the curb from your property in order to permit a vehicle to cross the pavement, planning permission will usually be required. The pavement might need to be reinforced to withstand the vehicles’ weight and to prevent damage to the pipes or cables beneath.

A dropped kerb will be required if your plan is to drive your vehicle over the footway in your driveway, off a highway. You cannot drive on the footway if you don’t have a dropped curb. If you do so, you are breaking the law and enforcement action could be taken to prevent such practice.
