A kerb drop is a legal necessity if you want to drive across the pavement onto your residential or commercial property.

Any access onto a public highway from a residential or commercial driveway area should have a vehicle crossover.

Kerb dropping permits vehicles to cross the pavement from the road to a driveway and it is a legal necessity if you wish to drive across the pavement onto your property.

Putting in a vehicle access crossover can make a significant improvement to accessing your property as well as helping to make sure people do not park across your driveway.

The law regarding the access states: If you plan to drive a vehicle over the footway into your driveway off a highway, then you will need to make these changes to your access.

If you do not, you must never drive over the footway. If you do so, you are breaking the law and enforcement action could be taken to prevent such practice.

The pavement may need to be strengthened in front of the building, and in many cases, it may be necessary for lampposts, manhole covers and various other street furniture to be moved.

Kerb drops, also known as vehicle access crossovers, are an adaptation to the footpath. It entails lowering the kerb and laying new foundations to the paving to enable a car to be driven onto the front area of a property.

The work includes lowering the kerbstones and strengthening the pavement to create a ramp, and must solely be performed by an authorised company with Street Works Accreditation, and who have the required Public Liability insurance to fulfill the local authorities requirements.

Vehicle access cross overs comprise normally of 3 or 4 dropped kerbs with a tapered or transition kerb on either side. The standard maximum total width at road level for a VAC is 3.6 metres (i.e. normally 4 kerbs).

Our team have several years experience in putting in drop kerbs and making an application for the relevant planning permission. We are able to work in partnership with your local county council  whilst complying with all necessary regulations.

You can either apply to your local council for permission for kerb dropping outside your building or we are able to apply to your local authority on your behalf.

The massive growth in interest for off-street parking has seen a growing number of people drop kerbs to establish car standing at the front of their homes.

Research by home insurer Direct Line shows that off-street parking is regarded by estate agents as a desirable feature which adds market value to a property. This, combined with increasing parking limitations in many residential areas, has resulted in planning applications  increase greatly over recent years.

But while adding car standing space to the front of your home may add market value to your property, there are many things to think about, not least environmental consequences, and flooding is a big issue.

When you switch out a front garden with hard standing, rainwater can no longer absorb into the ground. As increasingly more households take this action, the collective effect seriously increases the threat of flooding, so it’s important to incorporate drainage in your plans.

Planning permission is normally required if you wish to drop the kerb outside your building to enable a car to cross the pavement. This is because the pavement may need to be strengthened to take the weight of motor vehicles and help prevent them from damaging the surface or any pipes or cables underneath. It is in addition to ensure the new access will never be a safety hazard to other highway users.

You can learn if you require planning permission by getting in touch with your local council (you can identify the relevant council at the government website). How much it costs to apply will be dependent on your location.

If permission is approved, you then you need to locate a local contractor to perform the work for you.

It’s certainly not a DIY job as the council will have requirements that service providers must meet. Some will only allow you to use their endorsed contractors, while others allow you to use your own, provided that they are certified to the requirements of the New Roads and Street Works Act 1991, and hold public liability insurance. In this case, there may be an added fee for highway inspections by the council.

But first it’s worth verifying if consent is likely to be given. Below is a checklist of considerations. If any one of these criteria is not really met, planning permission is probably to be declined:

  • Your front garden must be big enough for you to park your vehicle fully on your property.
  • The kerb must be at least 4.8 m from the front of your house; or 6m if the parking spot is in front of a door or garage.
  • The parking area should be at least 2.4 m wide.
  • The suggested access to your property should be more than 10m away from a road junction; 15m away from busy junctions or on primary roads.
  • It has to be at least 1.5 m away from street lamps and various other street furniture.
  • It must meet visibility guidelines; this depends upon the type of road.
  • Suitable drainage must be provided to take the excess surface water.
The removal of tree roots should be avoided.
  • The incline from your property to the road must not be too steep.
  • Lastly, you as the home owner must agree to the kerb being dropped; for example, a tenant can not apply on their landlord’s behalf.

Q and A’s

Prices can vary depending upon where you are located, what width you have, how many kerbs need to be dropped, and whether you need to extend an existing drop kerb. Some councils and contractors offer an extended dropped-kerb free of charge, while others charge up to £1800. The actual job usually takes between 1 and 2 days.

Highways Act 1980 Section 184 states that it is an offense to drive a vehicle on a footway or verge if there isn’t a proper vehicle crossing. These include the permission for a vehicle to cross the public footway and the physical lowering the kerb.

Five kerb sections will be required to make a driveway average. You will need to obtain permission from your local Council as highway authority, assuming that the Council owns the road and footpath. You might not be granted permission by the Council, whether it is a roads authority, planning authority, or both.

A dropped kerb is the sloped area where the vehicle crosses from the road to the front of the property. This is most often a driveway with drop kerb.

Parking a vehicle fully or partially across a dropped kerb is classed as an obstruction and either the police or local council can enforce the contravention. As absurd as it might sound, you can receive a PCN to park across your own dropped-kerb.

Parking across a dropped curb is a parking offense that can lead to a Penalty Fee Notice. This means that you can’t park in front of a dropped-kerb without permission.

Although adding a spot for your car will increase the property’s value, it will depend on where you live. You will need to apply to get a dropped curb outside your property.

At least 10 metres must be between the location of the vehicular access and the entrance to any junction or sharp corner. Your vehicle cannot be parked in an area that exceeds the roadway or pavement.

You will need to obtain permission to drop the kerb from your property so that a car can cross the pavement. The pavement might need to be reinforced to withstand the vehicles’ weight and to prevent damage to the pipes or cables beneath.

If you intend to drive a vehicle over the footway into your driveway off a highway, then you will need a dropped kerb. You cannot drive on the footway if you don’t have a dropped curb. If you do this, you may be charged with breaking the law.
