Highways Act 1980 Section 184, makes it a crime to drive a vehicle along a footway. These are the physical lowering (or dropping) of the kerb and permission to allow vehicles to cross on the public footway.

You will need to reduce five kerb sections for an average driveway. Assuming the Council owns the footpath and road, you will need to get permission from your local Council. The Council might decide not to grant permission, either as a roads authority or planning authority, or both.

Parking a vehicle fully or partially across a dropped kerb is classed as an obstruction and either the police or local council can enforce the contravention. Even though it sounds absurd, you may be issued a PCN to park on top of your own dropped curb.

Although adding a spot for your car will increase the property’s value, it will depend on where you live. Keep in mind, however, that dropping a kerb on your property outside will require you to submit an application.

Between the junction’s entrance and the proposed location for vehicular access, there must be at most 10m. No part of a vehicle parked within your property may overhang the pavement or road.

If you want to remove the curb from your property in order to permit a vehicle to cross the pavement, planning permission will usually be required. The pavement might need to be reinforced to withstand the vehicles’ weight and to prevent damage to the pipes or cables beneath.
