If permission is approved, you then you need to find a local specialist to do the work for you.

It’s definitely not a DIY job as the council will have requirements that contractors must meet. Some will only permit you to use their approved contractors, while others make it possible for you to use your own, so long as they are certified to the requirements of the New Roads and Street Works Act 1991, and carry public liability insurance. In this case, there may be an added fee for highway assessments by the council.

  • Your front garden must be big enough for you to park your vehicle completely on your property.

  • The parking area should be at least 2.4 m wide.
  • The proposed access to your property should be more than 10m away from a road junction; 15m away from busy junctions or on primary roads.

  • Finally, you as the homeowner must agree to the kerb being dropped; for example, a tenant can not apply on their landlord’s behalf.

Prices vary depending on where you live, how many kerbs are to be dropped and whether or not you wish to extend an already-dropped kerb. Some contractors and councils offer an extended dropped kerb for free, while some charge up to $1800 or more. The job typically takes about one to two days.

The Highways Act 1980 – Section 184, makes it an offence to drive a vehicle across a footway, or verge, where there is no proper vehicle crossover. These include the permission for a vehicle to cross the public footway and the physical lowering the kerb.

You will need to reduce five kerb sections for an average driveway. You will need to obtain permission from your local Council as highway authority, assuming that the Council owns the road and footpath. The Council could refuse permission, as a roads authority, planning authorities, or both.
